Principles
The client-attorney relationship is governed by an attorney-client agreement (Art. 394 et seq. CO). A written fee agreement is recommended; it specifies the scope of the engagement, the method of calculation (time-based or flat fee), advances, and expenses.
Methods of Compensation
- Time-based: at an hourly rate that takes into account the complexity and urgency of the matter.
- Flat fee: when the scope of the assignment allows it.
- Success fee: possible in addition to reasonable base fees, in a transparent and proportionate manner.
